Yesterday , the County Executive Committee Member ( CECM) for Finance and Economic Planning Mr George Odhiambo Nying'iro appeared before the County Assembly of Siaya to defend himself against the censure motion that was tabled by nominated MCA Hon. Dorothy Oinga.
In the session chaired by the Speaker of the County Assembly of Siaya Rt. Hon George Okode, Mr. Nying'iro who faced 10 grounds for censure defended himself by citing millions of payments made in contracts and supplies by the Department of Finance and Economic Planning.
Regarding the Pay As You Earn (PAYE) tax, he attributed issues to the exchequer, exonerating the County Government. He stated that the responsibility lies with the Office of the Controller of Budget. Concerning remittances for products from the Social Health Authority (SHA), he claimed that the systems and plans implemented by SHA do not permit erroneous payment entries, such as underpayments or overpayments. He asserted that these issues have hindered some of the by-products.
The Assembly has resolved that Nying'iro stands censured for the alleged acts of omissions and commissions, which undermine Articles 10, 73, and 201 of the Constitution of Kenya, 2010.
Among the charges is the non-remittance of salary by-products. The CECM has denied all charges.
The Speaker of the County Assembly, the Right Honourable George Okode, has ruled as follows:
- The Acting CECM for Finance and Economic Planning, Mr. George Nying'iro, stands censured.
- Although the CECM has vigorously defended himself against the accusations, the County Assembly will conduct thorough independent investigations within fourteen (14) days, after which resolutions will be issued by the Assembly.
The Office of the Governor is required to address the issues raised within thirty (30) days; failure to do so will result in appropriate actions being taken by the County Assembly against the responsible officer.
